General Provisions
Purpose and Intent
- The Foothills Park & Recreation District (“the District”), a quasi-municipal corporation and political subdivision organized under Article 1, Title 32 of the Colorado Revised Statutes (C.R.S.) as a Special District, is vested with the authority to adopt, amend, and enforce bylaws and rules and regulations for carrying on the business, objects, and affairs of the Board and of the special district.
- The business, objects, and affairs of the District includes the maintenance of good order on District property to achieve and promote the stated goals of creating community, enhancing health, and inspiring play, while seeking to protect the interests of the District, and the public, to the maximum extent possible.
- Therefore, the following Rules and Regulations are adopted by the Executive Director of the Foothills Park & Recreation District as the means by which the District shall regulate the use, conduct, and activities permitted on District owned, operated, or managed properties, to include but not be limited to any parks, trails, greenbelts, open spaces, facilities, buildings, or any other improvements, features, amenities, or miscellaneous structures erected upon such properties (“District property or properties”).
Application
- These Rules and Regulations shall be applicable to all District properties, regardless of classification or whether improved or not, and all persons entering, occupying, or otherwise making use of any District property.
- Personnel engaged in their official duties as District employees, contractors of the District, or volunteers for the District, or personnel representing any other governmental subdivision, to include emergency services personnel, or any other persons designated by the Executive Director or their designee, may be exempted from any sections of these Rules and Regulations, subject to any terms, restrictions, conditions, or limitations imposed, to perform official tasks or duties where such regulations would substantially interfere with their successful completion.
- Nothing in these Rules and Regulations shall be intended to be a limitation or restriction on the duties or powers vested in the Board or of the Executive Director of the Foothills Park & Recreation District.
- The Executive Director may amend these Rules and Regulations as needed, whereupon adoption of such amendments or revisions shall supersede and replace any previously adopted rules, regulations, or orders.
- Nothing in these Rules and Regulations shall be intended to reduce, limit, waive, override, or supersede any other applicable laws, ordinances, rules or regulations set forth by the State of Colorado, the Government of the United States, or of any other governing body possessing jurisdiction over any District properties, and all such applicable laws, ordinances, rules or regulations shall be in effect and must be complied with on all District properties.
Enforcement
- These Rules and Regulations shall be diligently enforced by any authorized employees or agents of the District, or by any law enforcement officers of this state or any political subdivision thereof, or any other duly authorized personnel, however administratively titled or commissioned, having jurisdiction over District properties.
- Such personnel authorized to enforce these Rules and Regulations shall be empowered with the authority to revoke or deny the use of any District properties, or to eject any individual(s) or group(s) acting in violation of, or refusing to comply with these Rules and Regulations.
- Any violation of these Rules and Regulations may subject the violator to law enforcement action, criminal prosecution, civil penalties or fines, and/or revocation of the use of Foothills Park & Recreation District properties and facilities.
Rules and Regulations
The following acts shall be prohibited on all District properties:
Alcoholic Beverages
Except as authorized by a District-issued permit or pursuant to licensed distribution or use at designated District facilities, the sale, possession, and/or consumption of alcohol shall be prohibited on all District properties, except:
- Robert F. Clement Regional Park
- Foothills Golf Course
- Meadows Golf Course
- Foothills Fieldhouse
- Edge Ice Arena
- Any other District properties as authorized by the Executive Director or their designee.
Amplified Sound
Use of any amplifiers, loudspeakers, microphones, bullhorns, or any other similar devices intended to increase the volume, range, distance, or intensity of speech, music, sound, or any other noise, shall be subject to review and permitting by the Executive Director or their designee, who shall have the sole discretion to determine if use of any such devices would constitute a nuisance or otherwise disturb the public peace. District personnel may revoke any permits issued, or request that the permittee adjust the volume output of any such devices to a reasonable level.
Closed Areas & Park Hours
It shall be prohibited for any persons to enter, use, or occupy any District properties when closed to public use or outside of the posted operating hours. Park hours shall be from to year round. Facility hours shall be as posted at each specific facility. District authorized activities shall be exempt from park hours.
Commercial Use/Advertising
Unless authorized by the Executive Director or their designee, it shall be prohibited for any persons to conduct any commercial activity on any District property, to include but not be limited to the sale, distribution, offering, sampling, soliciting, vending, bartering, bargaining, or advertisement for, or delivery of, any materials, items, goods, or services, whether for compensation or gratis, or for the solicitation of contributions, whether public, private, or non-profit.
Disruptive Behavior
It shall be prohibited for any persons to engage in any boisterous, threatening, abusive, insulting, or indecent behavior, to include use of indecent language, or to engage in any disorderly conduct or behavior tending towards a breach of the public peace, or otherwise impacting the safety and enjoyment of any District property.
It shall be prohibited for any persons to knowingly or intentionally obstruct, impair, hinder, harass, or otherwise interfere with District personnel, volunteers, or contractors engaged in the performance of their official duties, or to aid another person to do so, or to willfully refuse or fail to leave any District Property upon being requested to do so by District personnel.
Dumping or Littering
It shall be prohibited for any persons to dump, deposit, or leave any refuse, rubbish, trash, litter, garbage, or waste upon any District property, to include within sewers or storm drains, creeks, streams, ponds, lakes, or other waterways, or to bring any refuse, rubbish, trash, litter, garbage, or waste onto any District property for the purposes of dumping or depositing such items into any dumpster or disposal receptacle.
Such waste shall include but not be limited to, fill dirt, rubble, debris, yard waste, dead vegetation, discarded furnishings, medical waste, human or animal excrement or urine, animal remains, grease, charcoal, any chemical substances, oil, gasoline, combustible or flammable fuels, petroleum products, pesticides, herbicides, ashes, solvents, or any matter or material classified by law as a hazardous or toxic waste, or any other waste materials or foreign substances, whether liquid or solid, of every form, size, kind, and description.
Use of dumpsters or disposal receptacles to deposit common personal refuse or trash by persons using a District property for an authorized activity shall be excepted.
Feeding Wildlife
It shall be prohibited for any persons to feed, or attempt to feed, any wildlife, or to store any food upon any District property.
Fires
It shall be prohibited for any persons to burn any material, start, light, maintain, leave unattended, or fail to completely extinguish any fire, or to violate the conditions of any imposed fire restrictions or ban. Any device requiring or using an open flame shall be prohibited on all District property. This shall include but not be limited to bonfires, fire pits, candles, tiki torches, sky lanterns, and Bunsen burners. The proper use of gas fueled, or charcoal grills shall be excepted.
Fireworks
It shall be prohibited for any persons to possess, ignite, or discharge any fireworks or potentially explosive or combustible devices upon any District property. Fireworks shall include any article, composition, or device prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation.
Glass Containers
It shall be prohibited for any persons to possess any type of glass bottle or container upon any District property.
Golfing
Except for authorized activities at District golf courses, it shall be prohibited for any persons to drive, putt, or in any other fashion play or practice golf, or to use any golf clubs, with or without use of golf balls, upon, within, or in a manner which would cause any golf balls to land within, or pass through, any District property.
Horses on Irrigated Turf
It shall be prohibited for any horses to enter, be ridden, or remain upon, any areas of irrigated turf on District property. As necessary for the proper maintenance of health and sanitation, all horses entering or remaining upon any District property are required to wear manure bags.
Hunting or Harassment of Wildlife
It shall be prohibited for any persons, or any pet animal under their custody, control, or ownership, to hunt, harass, chase, harm, capture, kill, maim, or to possess any wildlife, or to alter, damage, destroy, remove, or in any other way vandalize wildlife habitat features, to include but not be limited to animal dens, burrows, dwellings, or nests, or for any persons to trap any animal, wild or domestic, or to place or set traps for the purposes of capturing any animal on District property without legal authority to do so. District employees, contractors, volunteers, or any other authorized personnel conducting authorized wildlife hazing, trapping, or habitat management activities shall be excepted.
Misuse or Modifying Park Property
It shall be prohibited for any persons to modify, alter, destroy, deface, damage, or otherwise misuse District property, or to disturb or remove any flora, turf, soil, grass, rock, sand, or gravel, to include but not be limited to digging, removing, destroying, injuring, mutilating, or cutting any tree, plant, shrub, bloom, or flower, present upon District property.
Misuse or modification of park property shall include but not be limited to, constructing, erecting, installing, or staking any structure or enclosure, to include but not be limited to any tents, shacks, booths, stands, amusement devices, inflatable devices, recreation equipment, carnival equipment, monuments, artwork, or any other improvements or furnishings, whether temporary or permanent, or to install or place any unauthorized items, or to stick, post, paste, erect, or otherwise affix or install, either by permanent or temporary means, any handbill, poster, placard, painted or printed matter, or signage of any construction, upon District property.
Banners, flags, placards, or other similar devices limited to organizational identification, amusement and inflatable devices, and geocaching and metal detecting are excepted, subject to the terms, conditions, and/or restrictions imposed by their respective permits. Sunshades marketed and sold explicitly for such purposes and not fully enclosed shall also be excepted.
Overnight Camping
Unless authorized by permit for the specifically designated and managed areas at the Foothills Fieldhouse, Foothills Sports Arena, or Robert F. Clement Regional Park, it shall be prohibited to occupy any District property for any type of camping, or permanent or semipermanent residential use, whether short, or long term, or to use or occupy any recreational vehicles, camper coaches or trailers, motor homes, tents, or any other similar camping equipment overnight on any District property.
Overnight Parking
It shall be prohibited for any persons to park, abandon, or otherwise allow any motor vehicle, to include but not be limited to any camper coach or trailer, commercial vehicle, motor home, multipurpose trailer, noncommercial or recreational vehicle, road tractor, semitrailer, special mobile machinery, trailer, trailer coach, truck, truck tractor (whether laden or unladen), utility trailer, or a detached trailer of any kind or description, to remain upon any District property overnight.
Vehicles present on District property overnight in connection with an official or authorized District activity or function, or any authorized vehicles owned or operated by the District, its contractors, employees, or volunteers, or any authorized service or emergency vehicles, shall be excepted from the foregoing provisions.
Parking
Motor vehicles must be parked properly in designated spaces at all times. It shall be prohibited for any persons to park any motor vehicle, to include but not be limited to any camper coach or trailer, commercial vehicle, motor home, multipurpose trailer, noncommercial or recreational vehicle, road tractor, semitrailer, special mobile machinery, trailer, trailer coach, truck, truck tractor (whether laden or unladen), utility trailer, or a detached trailer of any kind or description, in a manner that creates a hazard or obstructs traffic, or in an area designated and posted against parking, standing, or stopping, or in a designated parking space or passenger loading zone reserved for persons with disabilities.
Persons possessing and displaying a valid identifying license plate or placard shall be exempted when properly parked in a designated reserved parking space but may not block or otherwise occupy a designated passenger loading zone unless loading or unloading passengers. Authorized vehicles owned or operated by the District, its contractors, employees, volunteers, or any authorized service or emergency vehicles, shall be excepted from the foregoing provisions.
Permits
It shall be prohibited to conduct a group activity, special event, organized team activity (“OTA”), or any other activity requiring an exclusive reservation or use priority of any District property, without first obtaining a valid permit for such use. Permit holders shall have use priority of the specified District property, or portion thereof, during the duration for which the permit is valid, subject to the terms, conditions, and/or restrictions imposed by the issued permit. Issued permits shall pertain to a single, specific event or use, unless otherwise authorized. Unless authorized by the express written permission of the Executive Director or their designee, it shall be prohibited for any permit holder to sub-let any District property, or any portion thereof, to any other users, agencies, groups, or organizations other than the original permit holder.
Pet Control
It shall be prohibited for any persons entering, occupying, using, or remaining upon any District property to fail to keep any pet animal under their custody, control, or ownership on a leash, and under appropriate and adequate physical control, at all times while on District property. Leashes must be ten (10) feet or less in length. It shall be prohibited for any persons to allow any pet animal under their custody, control, or ownership to run at large or be left unattended while on District property.
Qualifying service animals as defined by the Americans with Disabilities Act (ADA) Title II (28 CFR 35.136), shall be excepted from the foregoing provisions, provided the following conditions are met:
- The service animal is under the control of its handler by means of voice, signals, or other effective means
- and the use of a harness, leash, or tether would interfere with the service animal’s performance of work tasks.
Therapy, crime prevention, companion, or assistance animals are not defined as service animals under 28 CFR 35.136 and must be leashed and under appropriate and adequate physical control while on District property.
Pet Waste
It shall be prohibited for any persons entering, occupying, using, or remaining upon any District property to fail to immediately pick up, carry out, and deposit in an appropriate waste receptacle any excrement or feces deposited on District property by any pet animal under their custody, control, or ownership.
Piloted Craft
Except as authorized by law or under this rule, it shall be prohibited to launch, land, or operate in any manner, any piloted craft including, but not limited to, helicopters, airplanes, ultralights, gliders, hang gliders, paragliders, BASE jumping equipment, sky diving equipment, powered parachutes, hot air balloons, or boats, from, upon, or above any District property, including waters.
Rockets or Remote-Controlled Devices
Except as authorized by law or under this rule, it shall be prohibited to throw, discharge, launch, operate, fly, or land by remote control any type of unpiloted drone or unmanned aircraft system, model airplane, missile, rocket, car, boat, or any other remote controlled device of any kind or description, from, upon, or above any District property, including waters.
Electrically powered model aircraft shall be exempt from this rule in the specifically designated areas at the Schaefer Athletic Complex and Easton Regional Park, provided that the operator possesses a valid District-issued Park Fliers Permit and adheres to all rules and regulations governing such permit. Model rocket use may be exempted from these provisions by permit, subject to any terms, conditions, or restrictions imposed.
Snow Removal from Fields or Facilities
It shall be prohibited to use, or attempt to use, any snowplows, snow blowers, shovels, rakes, or other hand tools, to remove snow from any fields, turf areas (regardless of if artificial or real), ballfields, tennis courts, pickleball courts, or basketball courts.
Swimming, Wading, Boating, or Other Contact with Water Bodies
It shall be prohibited for any persons to allow any portion of their body to come into contact with any natural body of water, either standing or flowing, or in liquid or frozen state, or to launch or operate any type of watercraft, including but not be limited to, boats, rafts, innertubes, belly boats, kayaks, canoes, paddleboards, or any other floatation device or adjunct, on District property. Such contact shall include but not be limited to swimming, wading, boating, rafting, kayaking, canoeing, paddleboarding, floating, tubing, ice skating, or ice fishing.
Unauthorized Vehicles
It shall be prohibited for any persons to park or operate a motor vehicle of any kind or description, to include but not be limited to all-terrain vehicles, autocycles, golf carts or cars, low-power scooters, low-speed electric vehicles (including neighborhood electric vehicles), motorcycles, motorized bicycles (including mini-bikes, pocket bikes, and dirt bikes), off-highway vehicles of any kind or description, or snowmobiles, upon any portion of any District property not intended for such use, to include but not be limited to any park property, lawns, turf (whether real or artificial), athletic fields of any kind or description, restricted roadways, or bicycle or pedestrian pathways, or in any area declared and posted as prohibited to motor vehicle use by the District.
Authorized vehicles owned or operated by the District, its contractors, employees, volunteers, or any authorized service or emergency vehicles, or those which are being used to access a legal easement, or as authorized by a District-issued Temporary Access Permit, shall be excepted from the foregoing provisions.
Bicycles and electronic assisted bicycles shall be excepted from the foregoing provisions when operated on designated roadways, parking lots, or designated bicycle pathways. Toy vehicles, electric scooters, and any other motorized bicycle being operated solely under human power and without use of the attached motor, may be excepted from the foregoing provisions when operated on bicycle or pedestrian pathways, but only when operated in a non-motorized manner. This exception shall not include road scooters, segways, neighborhood electric vehicles, golf cars or carts, dirt bikes, mini-bikes, all-terrain vehicles (ATVs), go-karts, or mini pocket bikes. Other Power-Driven Mobility Devices (“OPDMD”), may be operated in any areas open to pedestrian use as authorized under 28 CFR 35.137.
Weapons and Devices Discharging Projectiles
It shall be prohibited for any persons, other than peace officers or other persons with legal authority, to possess, display, flourish, or to use or discharge any device capable, or intended to be capable, of discharging any type of projectile onto, through, or upon any District property or within any District facility or building.
Such devices shall include, but not be limited to, firearms of any kind or description, gas, spring, or air operated guns, pellet guns, airsoft guns, paintball guns, BB guns, archery equipment of any kind or description to include crossbows, slingshots, or any other such device or adjunct so designed as to propel a projectile. Archery equipment may be exempted from this section pursuant to a District-issued permit and in connection with District-sponsored archery classes.
Other weapons, such as blackjacks, nunchucks, brass knuckles, knives with blades in excess of 3″, explosive devices, incendiary devices, bombs, stun-guns, or any other deadly weapons of any kind or description, or similar artificial facsimiles, shall also be prohibited on all District property.
Glossary
These Rules and Regulations are to be interpreted and applied in accordance with their specifications and definitions and in accordance with the common and ordinary meaning of words and phrases not otherwise specified or defined. As used in this document, unless the context otherwise requires, the following words or phrases shall have the following meaning:
General Provisions
- The Board
- Shall mean the Board of Directors of the Foothills Park & Recreation District.
- Buildings
- Shall mean any structure, improvement, or any other amenity erected upon any District property to include, but not be limited to: concession stands, picnic shelters, restrooms (whether temporary or permanent), maintenance and storage facilities, or any other such structures or improvements, which may or may not be open for public use, which are owned, operated, or under the management of the District.
- The District
- Shall mean the Foothills Park & Recreation District.
- District Personnel
- Shall mean any regularly employed District staff member or employee, whether part-time, full-time, or seasonally employed, exempt or non-exempt, who receives compensation from the District for carrying on the business, objects, or affairs of the District.
- District Property or Properties
- Shall mean any parks, trails, greenbelts, open spaces, facilities, buildings, or any other improvements, features, or amenities, or miscellaneous structures, owned, or operated, or managed by the Foothills Park & Recreation District.
- Executive Director
- Shall mean the Executive Director of the Foothills Park & Recreation District.
- Greenbelt
- Shall mean any landscaped or natural open areas devoid of buildings and structures.
- Parks
- Shall mean any and all grounds, roadways, avenues, fields, trails, greenbelts, greenways, parking lots, or any other natural areas or features, or improvements made thereto, owned, operated, or managed by the District.
- Permit
- Shall mean any official written and revocable document issued by the Executive Director or their designee for granting a reservation or use priority for any parks, fields, buildings or portions of buildings, and/or recreation facilities.
- Park and Recreation District
- Shall have the same meaning set forth in 32-1-103(14) C.R.S.
- Person
- Shall mean any individual, association, partnership, or public or private corporation, any municipal corporation, county, city, city and county, or other political subdivision of the state, or any other public or private organization of any character.
- Facility or Recreational Facility
- Shall have the same meaning set forth in 29-7-107 C.R.S., and shall include any buildings erected thereupon, to include but not be limited to: recreation centers, pools, golf courses, ice arenas, indoor sports arenas, fieldhouses, tennis courts, ballfields, multipurpose fields, or any other similar recreational amenity or improvement, owned, operated, or under the management of the District.
- Recreational Activities
- Shall mean any passive and/or active activities undertaken by people of all ages for enjoyment, relaxation, health, or social interaction.
- Special District
- Shall have the same meaning set forth in 32-1-103(20) C.R.S.
- Special Event
- Shall be defined as any event or gathering hosting 800 or more persons which may include, but not be limited to, walks, runs, festivals, concerts, or private fundraisers, or any other such event or activity which may require temporary area closures or restrictions, or require ticketed entry, or which would otherwise impact the normal operation of District business.
Alcoholic Beverages
- Alcohol Beverage
- Shall have the same meaning set forth in 44-3-103(2) C.R.S.
Amplified Sound
- Noise
- Shall mean any sound which is unwanted, or which causes or tends to cause an adverse psychological or physiological effect on human beings.
Dumping or Littering
- Debris
- Shall include but not be limited to, waste building materials, packaging, rubble, concrete, asphalt, wood, cardboard, metals, bricks, dirt, rocks, vegetative or woody land clearing/landscape materials, and other inert waste.
- Junk
- Shall include but not be limited to scrap brass, copper, iron, lead, tin, zinc, and all other scrap metals and alloys, bones, rags, used cloth, used rope, used rubber, used tinfoil, used bottles, old or used machinery of any type, used tools, used appliances, used fixtures, used utensils, used lumber, used boxes or crates (fabricated of any material), used pipe or pipe fittings, used conduit or conduit fittings, used automobiles in non-operable condition, used tires, and other manufactured goods that are so worn, deteriorated or obsolete as to make them unusable in their existing condition.
- Litter
- Shall have the same meaning set forth in 18-4-511(3)(a) C.R.S.
- Refuse
- Shall have the same meaning set forth in 25-13-103(9) C.R.S.
- Sewage
- Shall have the same meaning set forth in 25-13-103(10) C.R.S.
- Trash or Garbage
- Shall include but not be limited to, refuse, waste, worthless or discarded material, worn or used items having little or no value, and material no longer usable for its original intended purpose.
Horses on Irrigated Turf
- Turf
- Shall be defined as any irrigated, low-growing, manicured drought-resistant grass or grass mix that spreads naturally to form a continuous sod mat that requires regular mowing.
Feeding Wildlife, Hunting, or Harassment of Wildlife
- Animal
- Shall have the same meaning set forth in 18-9-201(2) C.R.S.
- Harass
- Shall have the same meaning set forth in 33-1-102(24) C.R.S.
- Hunt
- Shall have the same meaning set forth in 33-1-102(25.5) C.R.S.
- Trap
- Shall have the same meaning set forth in 33-1-102(47) C.R.S.
- Trapping
- Shall have the same meaning set forth in 33-1-102(48) C.R.S.
- Wildlife
- Shall have the same meaning set forth in 33-1-102(51) C.R.S.
Misuse or Modifying Park Property
- Deface
- Shall have the same meaning set forth in 18-1-901(f) C.R.S.
- Structure
- Shall mean anything constructed or erected, the use of which requires a more or less permanent location on the ground, to include but be limited to, earthworks, ditches, canals, dams, reservoirs, pipelines, telephone, telegraph, or electric power lines, walks, driveways, and streets/roads.
Overnight Camping
- Camper Coach
- Shall have the same meaning set forth in 42-1-102(13) C.R.S.
- Camper Trailer
- Shall have the same meaning set forth in 42-1-102(14) C.R.S.
- Camping
- Shall mean the use of a temporary shelter, such as a tent, car, trailer, or mobile home to live in.
- Motor Home
- Shall have the same meaning set forth in 42-1-102(57) C.R.S.
- Noncommercial or Recreational Vehicle
- Shall have the same meaning set forth in 42-1-102(61) C.R.S.
Overnight Parking, Parking, Unauthorized Vehicles
- To abandon
- Shall have the same meaning set forth in 18-4-512(2) C.R.S.
- Abandoned Vehicle
- Shall mean a vehicle left on a street/road, right of way, or property without the consent of the owner and where such vehicle cannot be operated, license plates or other identifying marks have been removed, damage exists so extensively as to make the value of the vehicle junk or an attempt has been made to notify the vehicle owner and no effort occurs to remove such vehicle.
- All-Terrain Vehicle
- Shall have the same meaning set forth in 42-6-102(1) C.R.S.
- Authorized Emergency Vehicle
- Shall have the same meaning set forth in 42-1-102(6) C.R.S.
- Authorized Service Vehicle
- Shall have the same meaning set forth in 42-1-102(7) C.R.S.
- Autocycle
